TERMS OF SERVICE
OVERVIEW
Welcome to Held in the Middle. The terms “we,” “us,” and “our” refer to Held in the Middle.
Held in the Middle operates this website and online store, including the information, content, features, products, and services offered through it (collectively, the “Services”). Our online store is powered by Shopify, which provides the ecommerce platform that allows us to offer our products and Services to you.
These Terms of Service (“Terms”) describe your rights and responsibilities when you visit our website, interact with our content, or purchase products from Held in the Middle.
By accessing or using our website or purchasing from us, you agree to these Terms and our Privacy Policy. If you do not agree with these Terms, please do not use our Services.
SECTION 1 — USE OF OUR WEBSITE
By using this website, you represent that you are at least the age of majority in your state or place of residence, or that you have given permission for a minor dependent to use the Services under your supervision.
You agree to provide accurate, current, and complete information when placing an order or otherwise interacting with our Services.
You may not use our website or products for any unlawful or unauthorized purpose or violate any applicable laws through your use of the Services.
SECTION 2 — OUR PRODUCTS
We make every reasonable effort to accurately display and describe our products.
However, colors, textures, finishes, sizing, and other visual details may appear differently depending on your device, screen settings, lighting, photography, or manufacturing variations.
Because some Held in the Middle products may include printed, handmade, specialty, or limited-production elements, minor variations may occur and are not necessarily considered defects.
Product descriptions, features, pricing, availability, and quantities may be changed at any time without notice.
We reserve the right to discontinue products or limit quantities available for purchase.
SECTION 3 — ORDERS
When you submit an order, you are making an offer to purchase products from Held in the Middle.
We reserve the right to accept, decline, limit, or cancel an order when reasonably necessary, including in cases of suspected fraud, payment issues, inventory errors, pricing errors, product unavailability, or other circumstances affecting our ability to fulfill the order.
Payment must be successfully processed before an order is considered complete.
Please carefully review your order, shipping address, email address, and other information before submitting your purchase.
If we need to modify or cancel an order, we will attempt to contact you using the email address, telephone number, billing information, or other contact information provided with your order.
Purchases are also subject to our Return & Refund Policy.
SECTION 4 — PREORDERS
Certain products, including the Held™ Planner 2027 Edition, may be offered for preorder before inventory is available for immediate shipment.
By purchasing a preorder item, you understand and agree that:
- The product is not available for immediate shipment.
- Payment is collected when the preorder is placed.
- Production, freight, customs, carrier schedules, weather, and other circumstances may affect anticipated fulfillment and delivery timelines.
- Any estimated shipping or delivery timeframe provided is an estimate and not a guaranteed delivery date.
- We will make reasonable efforts to communicate significant delays or changes that affect preorder fulfillment.
Preorders may be canceled for a full refund before the individual order enters the fulfillment process.
Once an order has entered the fulfillment process, it may no longer be canceled. After delivery, the order is subject to our regular Return & Refund Policy.
SECTION 5 — PRICES, TAXES & PAYMENT
All prices are listed in U.S. dollars unless otherwise stated.
Prices, discounts, promotions, and offers may change without notice. The price charged will be the price displayed at the time your order is placed, subject to correction of obvious pricing or technical errors.
Unless expressly stated otherwise, displayed product prices do not include applicable sales tax or shipping charges.
Applicable taxes and shipping charges will be calculated and displayed during checkout when required.
You agree to provide current, complete, and accurate billing and payment information and represent that you are authorized to use the payment method provided.
SECTION 6 — SHIPPING & DELIVERY
Shipping costs and available shipping methods will be displayed during checkout.
Delivery and transit times are estimates only and are not guaranteed.
Held in the Middle is not responsible for delays caused by carriers, weather, customs, transportation interruptions, incorrect customer-provided addresses, or other circumstances outside our reasonable control.
Preorder products are subject to the additional production and fulfillment considerations described in the Preorders section above.
Please ensure your shipping address is complete and accurate before placing your order.
Additional shipping information is available in our Shipping Policy.
SECTION 7 — RETURNS & REFUNDS
Eligible returns are governed by our Return & Refund Policy.
Generally, eligible products may be returned within 15 days of delivery when they are unused, unwritten in, and in their original condition.
Customers are responsible for return shipping costs for change-of-mind returns unless otherwise stated.
If your order arrives damaged, defective, or incorrect, please contact us as soon as possible so we can work with you to make it right.
Please review our complete Return & Refund Policy for additional requirements and information.

SECTION 16 — DISCLAIMER OF WARRANTIES
To the fullest extent permitted by applicable law, our website and Services are provided on an “as is” and “as available” basis except for warranties expressly provided by Held in the Middle or rights that cannot legally be excluded.
We do not guarantee that the website will always operate uninterrupted, securely, or without error.
